Privacy Policy

At Daylight Exchange Inc. ("Daylight"), we are committed to protecting the privacy and security of your organization’s data. This Privacy Policy describes the types of data we collect and how we may use this data.

This Privacy Policy is incorporated by reference into and subject to the Daylight terms and conditions ("Terms"), set forth at www.daylightclimate.com/terms-and-conditions, in connection with the Daylight Platform. Some capitalized terms used in this Privacy Policy are defined in the Terms. By using and participating in the Daylight Platform, you acknowledge and consent to the collection of your data consistent with terms of this Privacy Policy.

The type of data we collect

Daylight requires users to submit certain data prior to receiving credentials to access the Platform. Additionally, Daylight collects data from users of the Platform. Such data includes (a) individual and corporate information, including, but not limited to company and individual name, email address, mailing address, and phone number, (b) certain low-carbon commodity producer and developer data related to projects and/or products, such as commercial operation date, pricing, energy production, construction costs, and other project- and/or product-related attributes required for diligence, (c) certain buyer data related to energy consumption, procurement goals, facility location, and other related data required for Daylight to facilitate diligence through the Platform, (d) certain investor data related to acquisition targets or project specifications (geography, size, technology, etc.), lists of preferred project developers, and other related data required for Daylight to facilitate diligence through the Platform, and (e) certain Platform usage data.

How we use your data

Daylight may display on the Platform the data you provide, including identifying information such as your organization’s name, project name, location, production attributes, and compliance documentation.

If you are a seller and choose to participate in a procurement process or engage in a transaction facilitated through the Daylight Platform, you will be required to provide additional project-level information. That information will be made visible to the sponsor of the procurement, the advisor of such buyer, and/or the prospective counterparty to the transaction.

Daylight may also use the data provided by users to generate reports, benchmarks, and market intelligence. These outputs may reference specific projects or organizations, and by submitting data you consent to such use in connection with the services provided through the Platform.

Daylight will not share project-level data with other producers for competitive purposes, unless you have provided explicit consent for such sharing.

Daylight may aggregate your data with other data to create compilations and analysis of such data in a manner that does not directly or indirectly, inherently or expressly, identify your organization. Daylight may share with other Platform users and the public such aggregated data.

The two previous paragraphs of this Privacy Policy are effective notwithstanding anything to the contrary in any mutual non-disclosure agreement, confidentiality agreement, or similar agreement between Daylight and your organization.

Cookies and web beacons

The Platform may use cookies (small text files placed on your device). Cookies allow us to store and honor your preferences and settings; enable you to sign-in; combat fraud; and analyze how our websites and online services are performing. We also use “web beacons” to help deliver cookies and gather usage and performance data. Our websites may include web beacons, and cookies, or similar technologies from third-party service providers. You have a variety of tools to control the data collected by cookies, web beacons and similar technologies. For example, you can use controls in your internet browser to limit how the websites you visit are able to use cookies and to withdraw your consent by clearing or blocking cookies.

Personal Data

Daylight will only use personal data collected pursuant to this Privacy Policy (i.e., personal contact information, and data collected in cookies and beacons) to manage your activity on the Platform and our relationship with you, for other legitimate business purposes, and for other purposes that may be legally required. Daylight will only use your personal data in a manner that is consistent with applicable law.

Daylight operates globally and therefore this personal data may need to be transferred to countries outside of where the personal data was originally collected. Because Daylight is headquartered in the United States, personal data collected in other countries is routinely transferred to the United States for processing. When we transfer your personal data to a different country, we will ensure that such transfer complies with applicable laws and legislation. Daylight relies upon terms, including those outlined in the Ststandard Contractual Clauses, for the collection, use, retention and transfer of personal data from the European Union to the United States and other countries.

Policy changes

We may change our Privacy Policy from time-to-time. We encourage you to refer to this Privacy Policy on an ongoing basis so that you understand our current Privacy Policy.
